SwitchUp Ltd. (the “Company”) respects the privacy of its customers and website visitors (the “Users”).

The information below is intended to help Users understand the Company’s privacy protection policy. This Privacy Policy explains the sources through which the Company collects information about Users of the website, the purposes for which the information is collected, what information is collected about Users, how the Company may use such information, and how the Company manages and stores it.

For the purposes of this Privacy Policy, the term “Information” means data relating to an identified or identifiable individual, which can reasonably identify a person, including through identifying details such as name, ID number, and additional data in accordance with the Protection of Privacy Law, 1981 (the “Law”).

It is clarified that any Information provided or that will be provided by the User to the Company, whether orally or in writing, depends on the User’s consent and willingness, and that such consent is not derived from any legal obligation. However, without receiving such Information, the Company may not be able to provide services to the User. The Information will be stored in the Company’s databases for the purposes specified in this Privacy Policy. For the purpose of fulfilling these objectives, the Company may transfer Information about Users to third parties as detailed in this Privacy Policy.

Collection of Information

As part of the use of the various services provided by the Company, the Company collects Information about Users as detailed below:

Browsing the Company’s website and landing pages across various platforms:

Technical information and digital identifiers (as detailed in the Cookies section below), contact details left by the User including full name, phone number and email address, and any additional information that the User provides to the Company.

Purchases, including purchases made through the Company’s website:

Full name, contact details, information regarding products purchased by the User, and any additional information that the User provides to the Company.

Purposes and Use of Information

The Company may collect and use User Information for the following purposes, in whole or in part:

To operate, manage and maintain the website
To send the User important information regarding changes in terms of engagement or services, updates to the Privacy Policy, and other administrative information

Transfer of Information to Third Parties

The Company may transfer User Information to third parties as detailed below.

Such transfer will include only relevant information necessary for the specific purpose for which it is transferred and will be carried out proportionately and for defined, legitimate purposes.

The Company may transfer the Information, in whole or in part, to third parties in one or more of the following circumstances:

Third parties that provide services to the Company, including but not limited to IT services, security systems support, information storage services, research and survey services, lawyers or other external professional advisors, and additional service providers assisting the Company in its operations and in providing services to Users, including hosting services, delivery services, and similar services
If the Company receives a judicial order requiring it to provide User details or Information in accordance with the law
In the event of any dispute, claim, demand, lawsuit, or legal proceedings between the User (or anyone on their behalf) and the Company (or anyone on its behalf)
In the event of a transfer, sale, assignment, acquisition, or merger of the Company and/or its assets or any part thereof, whether for consideration or otherwise, including in cases of change of control, in whole or in part.

The Company may also transfer Information if it believes that such transfer is necessary to prevent harm to the Company, the User, or any third party.

The Company may transfer Information to third parties located in other countries or jurisdictions (including cloud services). These jurisdictions may provide a level of privacy protection different from that provided under Israeli law. Providing Information to the Company constitutes consent to the collection, storage (including cloud storage), and transfer of the Information in accordance with this Privacy Policy.

External Applications and Social Media

The Company may provide tools allowing Users to share and link content from the website via social networks (such as the Company’s Facebook and Instagram pages) and other online services (“External Applications”).

The use of External Applications is not governed by this Privacy Policy but by the privacy policies of the respective External Applications.

External Applications may include content posted by the User on the Company’s pages or content shared with the Company. Users should note that publishing personal information that may identify them or others is their sole responsibility, and the Company shall bear no responsibility regarding the use of External Applications.

Information Security

The Company implements technical and physical measures to protect privacy and information security in accordance with accepted standards.

However, as is known, storing and transmitting information electronically, including via the Internet, can never be completely secure. Therefore, whenever a User provides information to the Company, particularly via the Internet, the User does so with full consent and awareness of the risks involved.

If the User has reason to believe that their interaction with the Company is no longer secure (for example, if they feel the security of information transmitted to the Company may have been compromised), they should immediately notify the Company using the contact details provided in Section 16 below.

The Company shall not be liable and shall be exempt from any responsibility for any damage, loss, or expense of any kind, whether direct, indirect, incidental, or consequential, incurred by the User or any third party in connection with the transmission of information to the Company, the collection, storage (including cloud storage), processing, or transfer of information to third parties, or in connection with the use of External Applications.

The Company will retain User Information for as long as necessary to fulfill the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law.

If the User provides Information to the Company regarding other individuals, including family members or other third parties, the User must do so only after:

Informing those third parties about the contents of this Privacy Policy, and
Obtaining their consent for the collection, use, and transfer of their information as described herein and in accordance with applicable law.

Cookies

The Company may use automated tools for collecting information, including cookies, pixels, SDKs, beacons, tags, and similar technologies (collectively: “Cookies”).

These technologies are sent to the device from which the User accesses the website and automatically store various information files.

Cookies may collect information such as:

The source from which the User arrived at the website
The User’s IP address (the User’s Internet computer address), including approximate geographic location derived from it

Additionally, deleting Cookies does not affect information that has already been stored by the Company or third parties.

Certain Cookies that are essential for the operation and management of the website cannot be disabled.

The Company may, at its sole discretion, modify this Privacy Policy from time to time without prior notice. The updated Privacy Policy will apply from the date it is published on the website.

Users may not assign their rights and/or obligations under this Privacy Policy to another party. The Company and anyone acting on its behalf may assign their rights and/or obligations.

The provisions of this Privacy Policy are in addition to any agreement, consent, or document existing or that may exist between the User and the Company. Nothing in this Privacy Policy derogates from any rights granted to the Company under any agreement between the User and the Company or under applicable law.
